We recently represented a computer hardware and software sales representative resolve a dispute with the former distributor he had served for several years. The former distributor initially sued our client in federal court for alleged trade secret violations, but we successfully argued that the case should have been filed in private arbitration. We also were successful in curbing the plaintiff’s appetite for extensive written and oral discovery in federal court, with the judge agreeing with our client that discovery should take place in the arbitration setting.
